Mr. SRI MADAN KUMAR ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest in connection with Lauriya P. S. Case No. 127 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 427, 436, 354, 379, 504, 506 of the Indian Penal Code.
Allegedly, the petitioners and other co-accused along with female accused and male unknown accused being ten in numbers came and started abusing Ratan Chakravarti the dewar of the informant, co-accused Dilip Dhangad asked about Ratan Chakravarti, otherwise to kill her and they surrounded the house
Patna High Court Cr.Misc. No.49203 of 2017(3) dt.12-12-2017 2/3 and started damaging the household articles and the house of the informant and further they assaulted Deyadin of the informant after making her half necked.
Submission is of false implication and that the petitioners have been implicated due to dirty village politics and against them there is no specific allegation, the specific allegation is against co-accused Dilip Dhangad, the petitioners are poor persons, nothing has been recovered from their house and no one has been injured and the injury report of Basanti Chakravarti is nothing but pain which is simple in nature and further the informant was not treated by the doctor and as such the petitioners deserve sympathetic consideration. Learned APP fairly submits that against the petitioners there is no specific allegation and Basanti Chakravarti has received simple injury that was whole body pain.
In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Bettiah, West Champaran in connection with Lauriya P. S.
Patna High Court Cr.Misc. No.49203 of 2017(3) dt.12-12-2017 3/3 No. 127 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
