The petitioner is languishing in custody since 12.7.2019 in a case registered for the offences punishable under Sections 341,323,504 and 307/34 of the I.P.C.

The prosecution case is that in the background of previous land dispute the petitioner assaulted the informant with Garasa. It is submitted by learned counsel for the petitioner that the injury of the informant has been found simple in nature and there is no accusation of repeating the blow. It is further submitted that the petitioner also received injury in the free fight. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. It is submitted by learned APP that the specific accusation has been levelled against the petitioner.

Considering the nature of injury being simple and

Case No.212 of 2019.
