2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 323, 386, 506 and 34 of the Indian Penal Code, Section 50 of Bihar Prohibition and Excise Act and Section 7 of the Prevention of Corruption Act.
3. Allegation against the petitioner(police personnel) along with other co-accused person is that they demanded ransom money from the informant when the informant who was going by his truck along with his driver. It is further alleged that police personnel assaulted the informant and forcefully stopped his vehicle and despite showing documents of the vehicle, they stopped his vehicle and pressurized him for paying Rs. 15,000/-.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the ransom demand was not executed. The petitioner is a retired army personnel. A statement has been made in para-3 of this petition that he has got no criminal antecedent. Moreover, he is languishing in judicial custody since 06.08.2023.
5. Learned APP appearing for the state and learned counsel for the Vigilance have opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Baisi P.S. Case No. 326 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, V-Cum- Special Judge Vigilance Bhagalpur.
