JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Case No. C2/692/2017 (1096/2017), registered under Section 30 (a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the alleged recovery of 180 liters of Nepali Saufi wine was not from the possession of the petitioner but merely on the basis of suspicion the petitioner is made accused. It is further submitted that the said recovery is made from the pond, situated at the back of the house and the petitioner has no criminal antecedent. Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.3178 of 2018 (2) dt.30-01-2018 2/2 let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge- cum- Special Judge, Excise, Sitamarhi in connection with C2/692/2017 (1096 of 2017) .
