1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 191(2), 190, 115(2), 118(1), 109, 76, 324(4), 324(5), 352, 351(2) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of three cases, but then, all the cases have been instituted by the side of the informant as petitioner and the informant are related and are having dispute relating to land. It is next submitted that the informant alleges that while he was having tea at a tea shop when accused persons came and Anuthe assaulted by sword causing injury, thereafter Tamanna assaulted Imteyajul by garasa causing injury on head.

Ladle assaulted his uncle by sword causing injury near his ear. Further, Anuthe assaulted Anwarul by sword causing injury on head. The injured were taken to hospital and the reason for the occurrence is that accused were pressurizing to compromise Nanpur P. S. Case No.536 of 2024.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner. It is next submitted that petitioner is son of Anuthe, as such, he also came to be implicated. It is reiterated and submitted that petitioner and the informant and his side are related and are having dispute relating to land and both sides have instituted cases against each other.

5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner and taking into consideration the the fact that petitioner is not alleged to have assaulted, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in

No.67099 of 2025(2) dt.09-10-2025 3/3 the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri, Sitamarhi in connection with Nanpur P. S. Case No.554 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
