Earlier the prayer for bail of the petitioner was rejected taking note of the fact that he as well as two other coaccused were caught on the spot but bail of the petitioner is sought on the ground that having similar allegation co-accused Baijnath Yadav as well as Sanjay Yadav have already been released on bail.

Considering the aforesaid submissions as well as period of detention of the petitioner in custody, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Gaya,
