The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code.

Allegation is that 20-25 unknown miscreants armed with pistol, dab, knife, lathi and danda came and assaulted the brother of the informant and looted Rs.5 lacs, ornaments worth Rs.15 lacs, mobile phone from his house.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.03.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any

Patna High Court CR. MISC. No.63146 of 2019(2) dt.22-10-2019 2/2 incriminating article from the petitioner. The petitioner has not been put on T.I.P. Other co-accused has been granted bail vide Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Chakia P.S. case No.61 of 2019.
