The petitioner seeks bail in connection with Jehanabad P.S. Case no. 172 of 2018 registered under Section 30(a) of Bihar Prohibition & Excise Act-2016. 11.250 lts. of foreign liquor is said to have been recovered from the bag kept on the motorcycle and petitioner who was driving the motorcycle while another person namely, Sudharshan Kumar who was pillion rider were apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern with the seized liquor. The aforesaid liquor was being carried by the

Patna High Court Cr.Misc. No.20797 of 2018(2) dt.16-04-2018 2/2 pillion rider in the bag and petitioner had no knowledge of keeping the said liquor in the bag. He has no criminal antecedent. He has been languishing in custody since 03.03.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge, Jehanabad in connection with Jehanabad P.S. Case no. 172 of 2018.
