2. The petitioner is in custody since 20.05.2017 in connection with Nasriganj P.S. Case No. 97 of 2017 for the alleged offences under Sections 25(1-B)a, 26 and 35 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated in connection with alleged recovery of a country made double barrel pistol loaded with cartridges and two live cartridges from the right pocket of his trousers. It is further submitted that similarly situated co-accused Lav Singh has been granted bail by this Court in Cr. Misc. No. 45836 of 2017.
4. Having regard to the nature of accusations, gravity of the offence alleged as well as the criminal antecedents of the petitioner showing that there are four other cases in which he is accused of
Patna High Court Cr.Misc. No.2175 of 2018 (2) dt.16-01-2018 the offences under Sections 25(1-B)a, 26 and 35 of the Arms Act as well as Section 395 IPC, this Court is not inclined to grant privilege of bail to the petitioner at this stage. The bail petition stands dismissed with liberty to the petitioner to renew his prayer for bail after completion of 10 months in custody.
