2. The present writ application has been preferred for the following relief/s:- "(i) For issuance of an order, direction or a writ of certiorari for quashing and setting aside the order contained in Memo No. 1283 dated 11.09.2023 whereby and
Patna High Court CWJC No.15016 of 2023(2) dt.23-04-2024 2/3 whereunder the Sub-Divisional Magistrate, Danapur has illegally entertained an application filed by Respondent No.6, namely, Smt. Shikha Swaroup and has made a suggestion in the nature of an order allowing the Respondent No.6 Shikha Swaroup for making construction over the landed property and the land property bearing Khata No.112, Survey Plot Number 133, Tauji Number 4963 under Thana Number 174 at Mauja- Mamrejpur, Police Station- Naubatpur in the district of Patna while further directing that if the writ petitioners and others object, the Station House Officer (S.H.O.) will take necessary action.
(ii) For issuance of an order, direction or an appropriate writ for restraining the respondent 2nd set from making construction over the aforesaid property during the pendency of the present writ petition."
3. A perusal of the memo no. 1283 dated 11.09.2023
Patna High Court CWJC No.15016 of 2023(2) dt.23-04-2024 3/3 would show that it was simply observed by the concerned SubDivisional Officer, Danapur that in case there is any disturbance the concerned Police Station shall do the needful. The same cannot be construed as a direction.
