The petitioner seeks bail in connection with Rajauli P.S. case no. 51 of 2018 registered under Section 30(a) of Bihar Prohibition & Excise Act-2016.

30 lts. of country made liquor is said to have been recovered from the motorcycle of the petitioner and the petitioner was apprehended while its pillion rider managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern with the seized liquor. As a matter of fact, the said liquor was being

No.20552 of 2018(2) dt.13-04-2018 2/2 carried by the pillion rider in the bag taking lift from the petitioner and petitioner had no knowledge of keeping the aforesaid liquor in the said bag. He has no criminal antecedent. He has been languishing in custody since 17.02.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Nawada in connection with Rajauli P.S. Case no. 51 of 2018.
