The petitioner, in the present case, is seeking regular bail in connection with Pirbahor P.S. Case No.646 of 2017, Special Case No.171 of 2017, registered for offences alleged under Sections 22/23 of the N.D.P.S. Act.

Submission of the learned counsel for the petitioner is that the seizure is of 16 Puriya of Ganja and from the possession of this petitioner only 180 gram of Ganja was recovered. He submits that the petitioner has no criminal antecedent. Learned counsel further submits that the seizure is not in accordance with the provisions of Section 50 of the N.D.P.S. Act as well as under Section 100 of the Cr.P.C.

Considering the facts and circumstances particularly that the petitioner has no criminal antecedent and the quantity of Ganja is said to be 180 gm, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Patna in connection with Pirbahor P.S. Case No.646 of 2017, Special Case No.171 of 2017, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
