JUSTICE SANJAY PRIYA ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner and the State. The prayer for bail of this petitioner was earlier rejected by this Court vide order dated 28.06.2017 passed in Cr. Misc. 21652 of 2017 with liberty to renew his for bail after six months if no substantive progress is made in the Trial.
Report has been called for from the court below which has been received. From the report it appears that after framing of charge only one witness has been examined in this case till date and if prosecution succeeds to produce the witnesses, the trial may be concluded within a period of six months.
Learned counsel for the petitioner has submitted that petitioner is in custody since 20.08.2016. It has further been submitted that name of this petitioner has been disclosed after lodging of the First Information Report in the statement of witnesses namely, Sitaram and Mukesh Sharma under Section 164 Cr. P.C. as mentioned in
Patna High Court Cr.Misc. No.2188 of 2018 (3) dt.31-01-2018 2/2 paragraphs-114 and 115 of the case diary. The other co-accused persons have been granted bail by different coordinate Benches of this Court vide orders dated 28.11.2016, 19.4.2017, 15.11.2017 and 18.12.2017 passed in Cr. Misc. 43787 of 2016, 16718 of 2017, 48725 of 2017 and 58817 of 2017 respectively.
Considering the facts and circumstances of the case. let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 1st, Lakhisarai, in connection with Sessions Trial No. 61 of 2017 arising out of Lakhisarai P.S. Case No. 235 of 2016, G.R. No. 649 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
The petitioner will cooperate in conclusion of the trial and he will remain present on each and every date of trial till disposal of the case and will not try to hamper the trial by intimidating or influencing the witnesses. Any two subsequent defaults without any valid reason, will result in cancellation of bail bonds in the court below. (Sanjay Priya, J) S.Ali/- U T
