Petitioner, already in custody, seeks bail in connection with Pirpainti P.S. Case No.30 of 2017, registered under Sections 364, 302, 201 and 120(B) of the Indian Penal Code. Allegation in brief is that the husband of the informant did not return back and after five days thereafter his dead body was found and suspicion is raised against the petitioner that Raushan Gupta, one of the co-accused, had hired the petitioner for killing the deceased.

Learned counsel for the petitioner submits that except suspicion raised against the petitioner that he had talk on mobile with Anjani Kapri, who also called on mobile of the deceased, there is no other material, moreover the petitioner has also no

Having considered the aforesaid facts and circumstances, petitioner Raju Yadav @ Rajendra Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bhagalpur in connection with Pirpainti P.S. Case No.30 of 2017 with condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
