1. Heard learned counsel for the petitioners and the learned APP for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 2 is a woman and is wife of petitioner no. 1 and the informant alleges that on 22-6-2025 his uncle Dinesh started constructing wall on his land, on objection, 13 named accused persons

No.71643 of 2025(3) dt.11-02-2026 2/3 including the petitioners came and petitioner no. 1 and Dinesh assaulted informant's brother and sister by rod and kulhari, further petitioner no. 1 assaulted Arti by rod causing injury on eye and head, while Surendra assaulted Vicky by bamboo on back and Surendra snatched Rs. 40,000 from his pocket while Prince snatched chain of his sister.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place. It is also submitted that petitioners and the informant are related. It is further submitted that no doubt petitioner no. 1 is alleged to have assaulted the brother and sister of the informant, but then the injury suffered has been opined to be simple in nature and the blow is not alleged to have been repeated. It is also submitted that petitioners are not criminals and there is no specific allegation against petitioner no. 2.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners, but then fairly submits after perusing the case diary that the injury suffered by the injured has been opined to be simple in nature.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Samastipur (Muffasil) P.S. Case No. 275 of 2025, subject to the conditions as laid down under Section 482
(2) of the BNSS.
