The petitioner seeks pre-arrest bail in connection with Kusheshwar Asthan P.S. Case No.07 of 2017 registered under Sections 447, 448, 341, 323, 380, 427, 307 and 354/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that the present case is counter blast of Kusheshwar Astahan P.S. Case No.08 of 2017 registered by mother of the petitioner against the informant of the case in which members of the prosecution party have been granted pre-arrest bail vide A.B.P. No.158 of 2017. He further submitted that the injuries alleged to have been
Patna High Court Cr.Misc. No.50755 of 2017 (3) dt.09-11-2017 2/2 caused to the informant of the case were found to be simple in nature.
Having regard to the submissions made above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Biraul, Dharbhanga in connection with Kusheshwar Asthan P.S. Case No.07 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
