JUSTICE ARUN KUMAR ORAL ORDER 30-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.9.2017, seeks bail in Jhajha PS Case No. 228 of 2016 registered under Sections 25(1-b) a, 26, 35 of the Arms Act and Sections 16, 17, 18, 19, 20, 21 and 22 of UAP Act.

The allegation in brief is that the police on tip off members of extremist ground have assembled in the forest area, reached there and one person Pairu Yadav was apprehended and some arms were also recovered from the spot, the apprehended person disclosed the name of other persons who had assembled there including the name of the petitioner.

Learned Counsel for the petitioner submits that except disclosure of name of the petitioner by Pairu Yadav there is no other material besides criminal antecedent and in the present case he is in custody since 18.9.2017.

Having considered the said facts and circumstances, the petitioner, namely, Prahalad Baranwal @ Prahlad Modi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Jamui in connection with Jhajha PS Case No.

Patna High Court Cr.Misc. No.18407 of 2018 (2) dt.30-03-2018 228 of 2016 on the following conditions:- (i) one of the bailors must be a close family members of the petitioner.

(ii) the petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled. (Arun Kumar, J.) Snkumar/- U T
