JUSTICE ARUN KUMAR ORAL ORDER 23-02-2018 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners, already in custody, seek bail in connection with Gurua P. S. Case No. 116 of 2017, registered under Sections 302, 201/34 of the Indian Penal Code.

Allegation in brief is that the informant's brother along with his cousin had gone to market but did not return back. Later on, the dead body of both persons were found by the side of the river and the informant suspects that accused persons, named in the F.I.R. Killed their brother due to enmity. Learned counsel for the petitioners submits that except suspicion, there is nothing found against the petitioners and only

Patna High Court Cr.Misc. No.5004 of 2018 (3) dt.23-02-2018 2/2 substantial evidence has been found against co-accused, Ajay Mandal but not against these petitioners and they have clean antecedents. It is also submitted that these petitioners are in custody since 30.08.2017.

Having considered the said facts and circumstances, that both petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, Judicial Magistrate, Sherghati, Gaya in connection with Gurua P.S.Case No. 116 of 2017.
