2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 103 , 191 ( 2 ), 190, 127 (1) , 115 ( 2 ), 109, 118 (1) , 117 ( 2 ), 74, 352 and 351 ( 2 ) of the BNS.
3 . As per F.I.R., informant namely, Rambali Das alleged that all the accused persons including this petitioner came and assaulted informant and this petitioner assaulted elder son of informant by rod, danda and other co-accused persons assaulted other family members of informant. Later, brother of informant died.
4. It is submitted on behalf of the petitioner that specific allegation of assault to brother of informant ( deceased )
Patna High Court CR. MISC. No.67849 of 2025(3) dt.07-11-2025 2/2 is against other co-accused persons. So far as, this petitioner is concerned, he assaulted elder son of informant with lathi due to which he sustained injury and doctor has found the injury simple in nature . Petitioner claims clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, clean antecedent of this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Shergati District- Gaya in connection with Gurua P.S. Case No. 393 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
