JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 20.10.2017, seeks bail in Barharia PS Case No. 357 of 2017 registered under Sections 302/34 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that two motorcycle borne criminals followed the informant and his brother while going on motorcycle and shot at his brother causing his death. Learned Counsel for the petitioner submits that the FIR is against unknown, during investigation it has transpired that the two motorcycle borne persons were Jitendra Yadav and Umesh Yadav, this petitioner is father-in-law of Ramesh Yadav, younger brother of Umesh Yadav, so he has been implicated in this case and he has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Gopaljee Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Siwan in connection with Barharia PS Case No. 357 of 2017.
