ANJANA MISHRA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.07.2019 in connection with Special Case No.2032 of 2017 arising out of Economic Offence P.S. Case No.09 of 2017 registered for the offence under Sections 30(a), 38 and 41 of the Bihar Prohibition & Excise Act and Sections 420 and 120-B of the Indian Penal Code.

Learned counsel for the petitioner submits that only on suspicion, the petitioner has been taken into custody though the alleged recoveries of huge quantity of foreign liquor were from the house of one Dr. Upendra Narayan Prasad. The only allegation against the petitioner is that he is a tenant in the said

Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection Special Case No.2032 of 2017 arising out of Economic Offence P.S. Case No.09 of 2017.
