JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 This is an application for grant of anticipatory bail in connection with Bahera P. S. Case No. 04 of 2017, disclosing offences under Sections 498A, 494 and 34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Petitioner happens to be the husband of daughter of the informant and there is allegation of demand of dowry, for that, assaulting her with physically and mentally. Submission of learned counsel for the petitioner is that in this case a compromise has been reached between the parties in the Panchayati, which will appear from Annexure 2 and she has taken away articles and petitioner was to pay Rs.90,000/-, but at that time she was not paid the said amount and for that a sale deed of a piece of land was executed in her favour.

No.61922 of 2019(2) dt.27-09-2019 2/2 Having heard both sides, in view of the facts, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on provisional bail to the satisfaction of the learned court below. During that period, the learned court below shall issue a notice to the opposite party no.2. Once she appear, the learned court below may verify the factum of compromise reached between them, if the compromise is genuine, the court below shall confirm the bail bonds of the petitioner and if not genuine, the learned court below after hearing both the parties either shall confirm the bail bonds of the petitioner, or direct the petitioner to surrender and pray for regular bail.
