Petitioner, already in custody, seeks bail in connection with Madhepur P.S. Case No.101 of 2017, registered under Section 395 of the Indian Penal Code.

Allegation in brief is that 13 dacoits committed dacoity in the house of the informant.

Learned counsel for the petitioner submits that neither the petitioner was put on TIP nor any incriminating article was recovered from his possession, only material against him is disclosure of his name by one Raju Mukhiya and his confessional statement, the petitioner has only one criminal antecedent of theft and has been in custody since 07.11.2017.
