The petitioner has filed the instant application for grant of bail in connection with Dumra P.S. Case No. 178 of 2018 (District Sitamarhi) registered for the offence punishable under sections 328, 302 and 34 of the Indian Penal Code. As per the allegation in the FIR, a suspicion has been raised by the husband of the deceased that his wife had been poisoned to death by his grand daughter in conspiracy with his son Mahindra Singh who is the petitioner herein along with his wife.

It is submitted by learned counsel for the petitioner that the death of his mother took place on 08.05.2018 and on the same day the inquest report was prepared in presence of the

Patna High Court CR. MISC. No.62216 of 2019(3) dt.20-11-2019 2/2 informant. Thereafter the dead body was received by the petitioner's son and it is after cremation that an unfounded suspicion has been raised by his father. It is further submitted that besides the suspicion, there is no material against the petitioner.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration that the petitioner has no criminal antecedent and is in custody since 24.06.2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 178 of 2018 (District Sitamarhi) (Partha Sarthy, J) Prakash/- U
