The petitioner seeks bail in connection with Akbarpur P.S. Case No. 62 of 2022 registered for the offence under Section 395, 397, 307 of the Indian Penal Code. The petitioner is accused in large number of cases including Wazirganj P.S. Case No. 94 of 2022. The following order was passed by this Court in Criminal Misc. No. 46479 of 2022 on 25.01.2023:- Heard learned counsel for the petitioner and learned APP for the State.

Let the defect(s), if any, be removed within a period of four weeks from today.

This application for grant of regular bail arise out of Wazirganj P.S. Case No. 94 of 2022

Patna High Court CR. MISC. No.67276 of 2022(4) dt.22-05-2023 2/3 registered for the offence punishable under Sections 25(1-B)A, 26, 35 of Arms Act.

The petitioner was caught on the spot.

He has an antecedent list of eight cases.

Considering the aforesaid fact, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected.

The District Judge, Gaya, the District Judge, Nalanda, the District Judge, Nawada and District Judge, Patna are directed to get the trial of the following cases pending against the petitioner expedited:- I. Wazirganj P.S. Case No. 557/21 II. Wazirganj P.S. Case No. 52/22 III. Deep Nagar P.S. Case No. 91/22 IV. Akbarpur P.S. Case No. 62/22 V. Chandi P.S. Case No. 383/19 VI. Sahanpur P.S. Case No. 53/19 VII. Fatuha P.S. Case No. 748/19 VIII. Wazirganj P.S. Case No. 95/22 Let a copy of this order be communicated to the District Judge, Gaya, the District Judge, Nalanda, the District Judge, Nawada and District Judge, Patna for its compliance through FAX and e-mail forthwith.

Learned counsel for the petitioner submits that the trial of the petitioner is not being expedited and charge has not been framed in Wazirganj P.S. Case No. 94 of 2022.

No.67276 of 2022(4) dt.22-05-2023 3/3 When the petitioner is accused in cases which are registered in Gaya, Nawada and Patna, the trial of the petitioner will take some time. The petitioner cannot take advantage of having committed crime in several districts and thereafter say that his trial is not being expedited.

In the present case also materials have to connect the petitioner with the crime.

In view of the facts and circumstances, as mentioned above as well as considering the criminal antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The trial of the petitioner in all the cases is directed to be expedited as has been directed in Cr. Misc. No. 46479 of 2022.
