2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.

3. The allegation made in the FIR is that the daughter of the informant became traceless and upon search, he got to know that one Dhanu Kumar and the petitioner had taken her along by hatching a conspiracy as later the petitioner told the informant that his daughter and Dhanu Kumar were in Varanasi.

4. Learned counsel for the petitioner submits that the allegations levelled against the petitioner are totally false and

Patna High Court CR. MISC. No.70532 of 2024(6) dt.05-05-2025 2/3 as a matter of fact, there is a love relationship between the daughter of the informant and co-accused Dhanu Kumar and the victim girl had gone along with him on her own will and was living with him.

A counter affidavit has been filed on behalf of the State and learned counsel for the State points towards the statement of the victim girl recorded under Section 183 of the B.N.S.S., wherein she has made a categorical statement that she had been talking to co-accused Dhanu Kumar for the past two years and she had gone along him to Punjab and even got married to him in a temple. Upon perusal of the statement of the victim girl, it would appear that there is no reference at all to the name of the petitioner in the said statement.

Having regard to the facts and circumstances of the case, since there is no reference to the name of the petitioner in the statement of the victim girl recorded under Section 183 of the B.N.S.S., let the above named petitioner, who has no criminal antecedent, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court
