112 lts. of foreign liquor is said to have been recovered from the Magic vehicle and accused Satyendra Yadav, Vikky Kumar and Ranjit Kumar were apprehended by the police. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner was not apprehended on the

Patna High Court Cr.Misc. No.2287 of 2018 (2) dt.23-01-2018 2/2 spot. He has been named in the case by the co-accused Satyendra Yadav who has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 21.12.2017 passed in Cr. Misc. no. 61219 of 2017. Petitioner has no criminal antecedent. The petitioner has been languishing in custody since 14.12.2017. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 6th Addl. Sessions Judge-cum-Spl. Judge, Nalanda at Biharsharif in connection with Ben P.S. Case no. 120 of 2017.
