2. The petitioner apprehends his arrest in a case registered for the offence punishable u/s 126(2), 115(2), 118(1), 109(1), 303(2), 3(5) of the B.N.S..
3. As per prosecution case, on account of land dispute, it is alleged that the petitioner assaulted the informant with sword and took away Rs.15,000/-.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. It is further submitted that the present case is counter blast of Baikunthpur P.S. Case No.128 of 2025, which was instituted by the petitioner. Doctor has found the injury to be simple in
Patna High Court CR. MISC. No.67693 of 2025(2) dt.24-09-2025 2/2 nature. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, simple nature of injury and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned court of learned Chief Judicial Magistrate, Gopalganj, in connection with Baikunthpur P.S. Case No.139 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
