JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bhagwanpur PS Case No. 5 of 2018 registered under Sections 341, 323, 504, 109/34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that due to land dispute quarrel took place and the petitioner is said to have shot on the hand of one Shyama Bind.

Learned Counsel for the petitioner submits that there is land dispute between both sides and the injury report show that the injury is lacerated wound simple in nature, the petitioner is in custody since 18.2.2018.

Having considered the said facts and circumstances, the petitioner, namely, Eshwar Dubey @ Ishwar Dubey is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kaimur at Bhabua in connection with Bhagwanpur PS Case No. 5 of 2018.
