Petitioner, already in custody, seeks bail in connection with Halsi P.S. Case No.64 of 2017, registered under Sections 25(1-b) a/26/35 of the Arms Act.
Allegation is that while the petitioner along with other were riding a motorcycle on suspicion apprehended by the police and one country made loaded pistol along with two live cartridge were recovered from his possession.
Learned counsel for the petitioner submits that the petitioner is in custody since 14.06.2017 and another co-accused was admitted to bail by the court below. However, the petitioner has got criminal antecedents of two cases of robbery, so the prayer of bail of the petitioner is rejected in connection with Halsi P.S.
Patna High Court Cr.Misc. No.2338 of 2018 (2) dt.17-01-2018 2 /2 Case No.64 of 2017, pending in the court of learned A.C.J.M.-II, Lakhisarai.
However, the petitioner may renew his prayer of bail after framing of charge.
