2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 09, 40(2), 50(5) and 58(1) and 51 of the Wild Life Forest Act.
3. As per the prosecution story, on secret information about killing of black deer, the Forest Officer after forming the team reached Chenari police station and confronted the SHO and checked his vehicle and found meat of dead black deer and also the head. The entire search operation was video-graphed and then upon enquiry, the SHO informed that on information, he had intercepted the petitioner amongst others but some of them were managed to escape.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner rather the recovery of meat of black deer was from the vehicle of SHO. This petitioner has been framed by SHO to save his skin. Moreover, the petitioner is languishing in judicial custody since 01.07.2024 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Forest P.S. Case No. 11 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram.
