====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Bihar P.S. Case No. 628 of 2021, registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.

3. There is no direct evidence indicating the petitioner's participation in the alleged crime. It is stated that the petitioner had called the deceased and subsequently his dead body was recovered. One Prakash Kumar, who had allegedly called the deceased along with the petitioner, has already been granted bail by this Court.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The

5. Learned A.P.P. and learned counsel for the informant have vehemently opposed the prayer for bail.

6. Considering the nature of the allegations and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif, Nalanda/ concerned Court below in connection with Bihar P.S. Case No. 628 of 2021.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
