Petitioner, already in custody, seeks bail in connection with Forbesganj P.S. Case No.559 of 2017, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR is against unknown, except disclosure of name of the petitioner as one of the associates of Saifulla who made confessional statement before the police, there is no other material, neither any incriminating article was recovered from possession of the petitioner nor he was put on TIP, the police has submitted charge sheet and the petitioner is in custody since 10.09.2017.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.11820 of 2018(3) dt.09-04-2018 2/2 circumstances and the fact that there is no material against the petitioner except disclosure of his name in the confessional statement by a co-accused, petitioner Bechan Ansari @ Md. Bechan Mian @ Md. Beachan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No.559 of 2017.
