2. Petitioners apprehend arrest in a case registered for the offence punishable under sections of the 420, 376, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, co-accused Nagendra Kaji established physical relation with the victim on false promise of marriage. Later on, petitioners refused to marry her.

4. It is submitted on behalf of the petitioners that these petitioners are innocent and have falsely been implicated in this case because they happen to be father and brother of coaccused Nagendra Kaji against whom there is specific allegation

Patna High Court CR. MISC. No.68772 of 2025(2) dt.07-10-2025 2/2 of committing rape on the informant. No overt act has been alleged against these petitioners. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of all these petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Bettiah, West Champaran in Sahodara Police Station Case No. 168 of 2022, subject to the conditions laid down under section 482 of the B.N.S.S.
