Heard learned counsel for the petitioner and learned APP for the State.

The learned counsel appearing on behalf of the petitioner submits that petitioner had approached this court seeking anticipatory bail by filing Cr. Misc No. 49825 of 2025 and the same was allowed by an order dated 12-8-2025 with a condition that one of the bailors of the petitioner shall be his father, Kauri Tiwary. It is next submitted that the father of the petitioner is also known by alias names Ramaji Tiwari and Ramjee Tiwari. It is submitted that from perusal of the order dated 11-6-2025 in ABP No. 749 of 2025, it would manifest that father of the petitioner has been described as Kauri Tiwari @ Ramjee Tiwari, but inadvertently in Cr. Misc No. 49825 of
Patna High Court CR. MISC. No.72246 of 2025(2) dt.10-10-2025 2/3 2025, the name of the father of the petitioner was typed as Kauri Tiwary only. It is next submitted that petitioner in compliance of the order dated 12-8-2025 in Cr. Misc No. 49825 of 2025 surrendered and his father furnished the bail bonds, but the same was not accepted on the ground that his name in the order dated 12-8-2025 in Cr. Misc No. 49825 of 2025 was recorded as Kauri Tiwary and not as Kauri Tiwary @ Ramaji Tiwari @ Ramjee Tiwari.

It is thus submitted that the instant modification application has been filed seeking modification of the father's name of the petitioner to read as Kauri Tiwary @ Ramaji Tiwari @ Ramjee Tiwari in the order dated 12-8-2025 in Cr. Misc No. 49825 of 2025.

The learned APP does not object to the said submission.

After hearing the learned counsel for the parties, the name of the father of the petitioner shall be read as Kauri Tiwary @ Ramaji Tiwari @ Ramjee Tiwari in the order dated 12-8-2025 in Cr. Misc No. 49825 of 2025 instead of Kauri Tiwary.

The order dated 12-8-2025 in Cr. Misc No. 49825 of 2025 is modified to the extent indicated above.

It is made clear that since 6 weeks time which was granted by the order dated 12-8-2025 in Cr. Misc No.49825 of 2025 to the petitioner for surrendering, has lapsed on account of pendency of the instant modification application before this court, as such if the petitioner surrenders on or before 31-102025, in that event the bail bonds of the petitioner shall be accepted on the same terms and conditions.
