JUSTICE BIRENDRA KUMAR ORAL ORDER 29-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Nabinagar P.S. Case No.13 of 2005, a case under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is in custody since 31.08.2017. Earlier the petitioner was allowed anticipatory bail in Cr. Misc. No.41922 of 2005 till completion of the investigation. After completion of the investigation the petitioner did not appear before the learned Court-below for considerably long period of three years and on that very reason the prayer for regular bail was refused by the learned Court-below.

Considering the aforesaid fact, let the petitioner,

Patna High Court Cr.Misc. No.5032 of 2018 (2) dt.29-01-2018 P2/ above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
