The petitioner apprehends his arrest in connection with Daudnagar P.S. Case No. 281 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Excise Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 29.37 liters of foreign liquor from the Car. Learned counsel for the petitioner further submits that there is no recovery of liquor from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that the petitioner has no any criminal antecedent mentioned

Patna High Court CR. MISC. No.62638 of 2019(3) dt.28-11-2019 2/2 in paragraph-3 of the bail petition.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.10,000/- in the court below/ Nazarat and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII cum Special Judge (Excise), Aurangabad in connection with Daudnagar P.S. Case No. 281 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

Such deposit of Rs.10,000/- shall abide by the outcome of the criminal case.
