2. The petitioner is apprehending arrest in connection with Biraul P.S. Case No. 62 of 2023, registered on 20.02.2023 for the offenses punishable under Sections 147, 323, 341, 324, 307, 427 and 376D of the Indian Penal Code.

3. According to the prosecution, the F.I.R. has been lodged against 10 named accused persons, including the present petitioner, with an allegation of assault on the members of a musical group using a sharp knife (diger). It is also alleged that co-accused Govind Chaudhary and Rahul Chaudhary have committed rape on the informant.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.74396 of 2024(4) dt.12-02-2025 2/2 allegation against the petitioner is omnibus and general. The petitioner has a clean antecedent. In the statement recorded under Section 164 of the Cr. P.C., the victim has not made any specific allegations against the petitioner.

5. Learned APP for the State vehemently opposes the prayer for bail.

6. In the aforesaid background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Biraul P.S. Case No. 62 of 2023, pending before the learned ACJM-1, Biraul, Darbhanga is hereby rejected.

7. However, it is directed that the petitioner shall surrender before the Trial Court within a period of four weeks from today. In case the petitioner surrenders within this period, the Trial Court is directed to pass an order on his surrender-cumbail application on the same day, without being prejudiced by the fact that the petitioner's anticipatory bail has been rejected by this Court.
