2. The petitioner seeks bail in connection with Gopalganj P.S. Case No. 231 of 2023 registered for the offence punishable under Sections 8, 20(b)(ii)(c) of the NDPS Act.

3. This is the second attempt by the petitioner for grant of bail. Earlier, this Court vide order dated 29.11.2023 in Cr. Misc. No. 74462 of 2023 had dismissed the regular bail of the petitioner.

4. Learned counsel for the petitioner submits that the last witness was examined on 02.07.2024 and thereafter, no witness has turned up. He further submits that similar situated Bigan Ansari has since been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 62293 of 2023 dated 13.12.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.74519 of 2024(2) dt.04-12-2024 2/2 prayer for regular bail of the petitioner.

6. There is recovery of 16 kg ganza from the petitioner, who is in custody since 30.03.2023.

7. Considering the the period of custody of the petitioner and grant of bail to the co-accused, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge, Gopgalganj in connection with Gopalganj P.S. Case No. 231 of 2023 , subject to the following conditions:

(i) The petitioner, after being released on bail is directed to mark his attendance at Jadopur Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present or through his lawyer as directed by the Court.
