2. The petitioner is apprehending his arrest in connection with Siswan P.S. Case No. 68 of 2022 for the offence under section 379 of the Indian Penal Code lodged on 22.03.2022 by the informant, Rajendra Tiwary.

3. As per the prosecution story, the informant alleged that he parked his motorcycle in the porch but later, it disappeared/stolen. This led to the FIR.

4. Subsequently, the investigation took the Police to the doors of the petitioner after the confession of Jai Kumar Patel who was arrested in connection with Raghunathpur P.S. Case No. 129 of 2022 in which the petitioner is also an accused.

5. Learned counsel for the petitioner submits that only because of criminal antecedent, he has been implicated, his

6. Learned APP opposes the prayer submitting that not only he has seven criminal antecedent under his belt, the FIR is of the year 2022, he has come to the Court after three years and the fact that the accused who has confessed and named this petitioner, is an accomplice in Raghunathpur P.S Case No. 129 of 2022 alongwith this petitioner.

7. Considering the submission of the parties as also the materials on record particularly the fact of his criminal antecedent as also that he alongwith the person who confessed against him are accused in Raghunathpur P.S Case No. 129 of 2022, in that background, it would be appropriate that the petitioner seeks bail.
