JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the respondents. Learned counsel for the petitioner submits that the case of the petitioner is covered by the decision of the Apex Court in Mukesh & Anr.Vs. The State of Bihar, reported in (2017)5 Scc 383 and subsequent judgment of the Apex Curt in the case of State of Bihar & Ors. vs. Dilip Kumar & Ors (Civil Appeal No. 5205 of 2019 disposed of on 28.7.2019. Considering the aforesaid, the writ application is disposed of with a direction to the respondents to examine the claim of the petitioner in the light of the aforesaid judgment of
Patna High Court CWJC No.20577 of 2019(2) dt.16-10-2019 2/2 the Apex Court and if it is found that the case of the petitioner is covered by the aforesaid judgment, the respondents are required to take appropriate decision in the light of the aforesaid judgment and pass appropriate order at the earliest, preferably within a period of sixty days from the date of receipt/production of a copy of this order.
