Petitioner is languishing in judicial custody since 14.11.2017 in connection with Ramnagar P.S. Case No. 433 of 2017 for offences punishable under Sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that on seeing sign board of U.G.M. Management Market Pvt. company, the informant entered and found the petitioner and coaccused Dilsad who promised to give service and took Rs. 1150/- from the informant but when he went for his service, he could not trace out the said company.
Patna High Court Cr.Misc. No.4003 of 2018 (3) dt.19-02-2018 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has been falsely implicated only on the basis of his own confessional statement and confessional statement of the co-accused before the police which has no evidentiary value in the eye of law and that he has been sufficiently punished.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, District-West Champaran.
