The petitioner is apprehending his arrest in connection with Bettiah Town P.S.Case NO.288 of 2019 dated 10.4.2019 registered for offences punishable under Sections 461/379 of the Indian Penal Code.

Allegation as per the FIR is of theft of the mobile and other articles from the shop of the informant and later on one Bablu Alam was arrested on the basis of information of the spy and Bablu Alam has named this petitioner and one Inverter was recovered from his house.

Submission of the learned counsel for the petitioner is that the Inverter is not shown as stolen articles in this case and except that there is nothing against the petitioner. He has no

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, this application is disposed of with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of the materials available in the case diary without being prejudiced by the order of this Court. With the aforesaid direction, this application is disposed of.
