Petitioner seeks bail in connection with Fulkaha P.S. Case No. 25 of 2018 for offences punishable under Section 414 of the Indian Penal Code.
The prosecution case, as lodged by the police personnel, is that on secret information that the stolen motorcycle is in the repairing shop of the petitioner, a raid was conducted and the motorcycle was seized. The petitioner could not produce any valid paper with regard to the said motorcycle nor revealed the owner of the said motorcycle. Accordingly, a seizure list was prepared.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.22269 of 2018 (2) dt.19-04-2018 2/2 petitioner that he is innocent, bears no criminal history and has just a motorcycle repair shop and did not know that the motorcycle was stolen one. He had even not recognized the person who had brought the motorcycle, as many customers come and go and it is small repairing shop.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Araria in connection with Fulkaha P.S. Case No.25 of 2018.
