2. This application has been filed for modification of condition '(d)' mentioned in Paragraph 7 of the order dated 19.06.2025 passed in Cr. Misc. No. 10403 of 2025 by this Court, whereby the petitioners were granted bail.

3. Learned counsel appearing on behalf of the petitioners submits that in view of the conditions as contained in Paragraph 7 (d), the bail bonds of the petitioners were not accepted, as inadvertently in Paragraph 3 of the main bail

Patna High Court CR. MISC. No.70337 of 2025(2) dt.26-09-2025 2/3 application, the criminal antecedent of the petitioners was inadvertently stated to be clean, however, as stated in the modification application, the petitioners carry one criminal case against their name apart from the present one.

4. The learned counsel for the petitioners submits that in view of such a condition, despite bail being granted to them, they could not have been released.

5. The aforesaid bail application bearing Cr. Misc. No. 10403 of 2025 was allowed with the particular condition stated therein:

"7 (d) The court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification".

6. In view of such a condition, it was mandatory upon the petitioners to come out clean in stating the antecedent, and as such the present application stands dismissed as withdrawn with a liberty to file a fresh bail application.

7. The petitioners are directed to move this court afresh with a prayer for bail.
