JUSTICE ARUN KUMAR ORAL ORDER 15-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bihar PS Case No. 648 of 2017 registered under Sections 414/34 of the IPC and Sections 25(1-B)a, 26 and 35 of the Arms Act. The allegation in brief is that the police during vehicle checking stopped a vehicle, searched the persons sitting in the vehicle and recovered a country made pistol and live cartridges from others however from the possession of the petitioner three mobiles were recovered.

Learned Counsel for the petitioner submits that the petitioner had taken lift in the vehicle, no fire arm was recovered from his possession except three mobiles and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Ravi Raj is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Bihar Sharif in connection with Bihar PS Case No. 648 of 2017 subject to verification of his criminal antecedent and if any criminal antecedent is found against the petitioner he shall not be released.
