2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise Act.

3 . As per the prosecution case , 427.32 litres of foreign liquor was recovered from the pick up van and this petitioner was seen fleeing from the place of occurrence .

4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of vehicle in question . No incriminating material has been recovered from conscious possession of the petitioner. Petitioner is in custody since 21.08.2024 . Chargesheet has already been submitted.

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 3 East Champaran Motihari in connection with Madhuban ( Garahiya) P.
