This is an application for grant of anticipatory bail in connection with Gai Ghat P.S. Case No. 260 of 2017 registered for the offence punishable under Sections 341, 323, 324, 447, 386, 504 and 506 of the Indian Penal Code.
The case of the prosecution is that the petitioner herein had tried to kill the son of the informant on non-payment of the extortion money.
The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and the allegation is false inasmuch as no firearm injury has been sustained by the son of the informant. It is further submitted that no injury whatsoever
Patna High Court Cr.Misc. No.9869 of 2018(2) dt.19-02-2018 2/2 has been received on the person of the son of the informant and the entire case is frivolous.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 15th -cum-Sub Judge-16th, Muzaffarpur in connection with Gai Ghat P.S. Case No. 260 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
