Petitioner, already in custody, seeks bail in connection with Balthar P.S. Case No. 52 of 2017, registered under Section 396 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation in brief is that while the informant's brother along with his Munshi was going on a motorcycle, some miscreants chased him and one shot at the informant's brother, causing his death and also looted Rs. 3,50,000/- and the mobile. Learned counsel for the petitioner submits that the First Information Report is against unknown and he was not identified in the T.I.P. by the Munshi of the deceased.

No.4060 of 2018 (2) dt.01-02-2018 2/2 However, learned counsel for the State submits that the petitioner was identified in the T.I.P. by some witnesses and on their disclosure, a part of the looted money was also recovered and this petitioner has also got seven serious criminal antecedents and in the main application this fact was suppressed stating that there is no criminal antecedent and in the court below also the same stand has been taken by the petitioner.

Having considered the said facts and circumstances, the prayer for bail of the petitioner, above named, is dismissed. (Arun Kumar, J) Praveen-II/- U T
