1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners have preferred this application for grant of anticipatory bail in connection with Shivsagar P.S. Case no.262 of 2024 registered under Sections 304B, 201 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that she married her daughter with one Satish Kumar Singh in the year 2018. After some days of marriage, all accused persons including the petitioners herein started to assault the informant's daughter mentally and physically on account of non-fulfillment of demand of dowry. He further states that on 15.06.2024 he received an information that his daughter was unwell and he was asked to come Sasaram where she was undergoing treatment. However, when the informant came to Sasaram, he could not meet the accused persons and subsequently came to know through the villagers that his daughter had been done to death and had also been cremated.

4. It is submitted by learned counsel for the petitioners that the petitioners are the father-in-law, the mother-in-law and the brothers-in-law of the deceased. There is general and omnibus allegation leveled against them in the F.I.R with regard to demand of dowry. The petitioners are also staying separate in mess from the deceased and her husband. It has further been submitted that as a matter of fact the deceased was suffering from some disease from the year 2013 for which treatment was going on in the hospital and a prescription along with the test report has also been annexed as Annexure-P/3 to the petition.

3/4 Learned counsel for the petitioners also draws the attention of this Court to paragraph no. 9 of the case diary in which contains the statement of driver of the vehicle in which the deceased was taken to the hospital for treatment and a perusal of the same would show that through out the way the deceased remained unwell. Learned counsel further submits in paragraph 11 of the petition that the husband of the deceased Satish Kumar Singh is in custody. They undertake to co-operate in investigation/trial.

5. The application for bail is opposed by learned APP for the State.

Considering the fact that the petitioners are the inlaws of the deceased who were staying separately from the deceased and her husband and also considering the fact that the husband who is primarily responsible for the welfare of the wife, is already in custody and further considering the fact that the deceased was also being taken for treatment, it is directed that the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Shivsagar P.S. Case no.262 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned
